ELIGIBILITY: The 24 Hour Fitness/Coke Vancouver 2010 Olympic Winter Games Sweepstakes (“Sweepstakes”) is open to legal residents of the United States (excluding Puerto Rico) and the District of Columbia and are 18 (19 in NE) years of age or older at the time of entry. Void where prohibited. Employees of 24 Hour Fitness, its advertising, promotion and marketing agencies and prize suppliers, and each of their immediate family members (spouse, and parents, children, and siblings, and their respective spouses, regardless of where they live) and individuals living in the same households of each of these individuals, whether related or not, of the above are not eligible to enter or win. Sweepstakes is subject to all applicable federal, state, and local laws.
SWEEPSTAKES TIMING: The Sweepstakes begin at 12:00:00 a.m. Pacific Time (“PT”) on November 16, 2009, and end at 11:59:59 p.m. PT on December 15, 2009 (“Promotional Period”).
TO ENTER: There are two (2) ways to enter the Sweepstakes during the Promotional Period: 1) Automatic Entry: An eligible 24 Hour Fitness Member will automatically receive one (1) Sweepstakes entry by visiting any participating 24 Hour Fitness Club location and working out. Membership card must be scanned or membership number captured at time of visit in order to be eligible for automatic entry. Only one entry per person per day will be recorded. 2) Alternate method of entry: Hand print your name, complete mailing address, telephone number, date of birth, & the words “24 Hour Fitness/Coke Vancouver 2010 Olympic Winter Games Sweepstakes” on a plain 3” x 5” piece of paper & mail it in a sealed, stamped & hand-printed #10 envelope to: 24 Hour Fitness/Coke Vancouver 2010 Olympic Winter Games Sweepstakes, P.O. Box 6000, Manhasset, NY 11030. Enter as often as you wish by mail, but each entry must be mailed separately, post marked by 12/15/09 and be received by 12/20/09. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted.
DETERMINATION OF WINNERS: One (1) grand prize winner will be randomly selected in a random drawing on or about December 21, 2009, from among all eligible entries. Winner will be notified via email or phone on file and will be required to sign an affidavit of eligibility/liability release, a publicity release where legal, and federal and state tax releases, and return these documents, properly executed, via fax, within 48 hours of notification and the original documents within seven (7) days of date of notification via regular mail. Non-compliance within this time frame and/or with these Official Rules; Sponsor’s inability to contact potential winner within a reasonable time period; or prize’s or prize notification’s return as undeliverable will result in such potential winner’s disqualification and, at Sponsor’s discretion and time permitting, the prize may be awarded to a potential alternate winner. ODDS: Estimated odds of winning a Prize are 1: 12,574,199; however, the actual odds of winning any prize depend upon the total number of eligible entries received.
PRIZE DESCRIPTION: Grand prize winner will receive a trip for two to the 2010 Vancouver Olympic Games from Feb 16-20th. The 5 day/4 night trip package includes roundtrip air transportation (coach), hotel accommodations, ground transportation, three meals each day plus all day snacks, amenity package including winter outerwear, accessories, and sports bag, local tour or sport activity, and one premium Olympic event ticket per person per day. Total Approximate Retail Value (“ARV”) of the Grand Prize is $20,000. All taxes, fees and expenses not specifically mentioned above and relating to the use and acceptance of the Prize are the sole responsibility of the Winner. The Winner and Winner’s guest must be able to travel to Vancouver, Canada Feb 16th-Feb 20th. If the Winner is unable to travel during designated trip dates, the Winner will forfeit the prize. Winner’s guest must be 18 or older take trip. Winner and guest must travel together. A valid passport is required to take the trip. Additional terms and conditions regarding use of the prize apply.
No substitution, transfer, or cash equivalent for the Prize. Prize will be distributed via U.S. Mail to each Winner. If a Winner refuses the Prize, fails to redeem the Prize in accordance with these Official Rules, is ineligible to win the Prize or is otherwise disqualified under these Official Rules, Sponsor (in its sole discretion) reserves the right to award the Prize to an alternate winner.
CONDITIONS OF PARTICIPATION: By entering, each entrant agrees to be bound by these Official Rules, including all eligibility requirements and the decisions of the Sponsor and judges, which are final and binding.
GENERAL: Sponsor will collect information from the entrants solely for the purpose of the prize drawing and to notify each Winner. Sponsor will not share this information with any third party, except as necessary for the administration of the Sweepstakes or Winner notification as applicable. Sponsor will deliver prize via U.S Mail. Sponsor is not responsible for lost, misdirected, inaccurate, incomplete, undelivered, damaged prizes sent to Winner of the Sweepstakes, including, without limitation, any error or problem that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of these Sweepstakes and/or modify these Official Rules at any time without notice. In the event of cancellation, Sponsor may void any entries it suspects are at issue and, at its discretion, if terminated, award prizes in a random drawing from among all non-suspect, eligible entries received up to the date of cancellation. Caution: Any attempt by an entrant or any other individual to undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate these Official Rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant’s eligibility to participate in the Sweepstakes.
DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California. Jurisdiction and venue shall be solely within the State of California.

SPONSOR & ADMINISTRATOR: The sponsor of this Sweepstakes is 24 Hour Fitness USA, Inc., PO Box 778, San Ramon, CA, 94583 . The administrator is Marden Kane, 36 Maple Place, Manhasset, NY 11030. Sponsor and each of its respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees will have no liability or responsibility for any claim arising in connection with participation in this sweepstakes or any prize awarded. ADDITIONAL RULES: No substitution, transfer, or cash equivalent for prizes. Sponsors may at their sole and absolute discretion substitute a prize of equal or greater value due to prize unavailability for any reason or for circumstances beyond its control.
